Accepting the Terms

1. Livingin.lt welcomes you. Your use of Livingin.lt is subject to the terms of a legal agreement between you and Livingin.lt. We provide the Livingin.lt Services to you, which are subject to the following Terms of Service ("TOS"). We may update these from time to time without notice to you. By accessing and using the Livingin.lt Services, you accept and agree to be bound by the terms and provision of the Terms of Service. Livingin.lt Website

1. These Terms of Service apply to all users of the Livingin.lt Website, including users who are contributors of any content, e.g. information, comments and other materials or services on the Website.
2. The Livingin.lt Website may contain links to third party websites that are not owned or controlled by Livingin.lt. Livingin.lt has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Livingin.lt will not and cannot censor or edit the content of any third-party site. By using the Website, you expressly relieve Livingin.lt from any and all liability arising from your use of any third-party website.
3. Sometimes when you use the Services, you may (as a result of, or through your use of the Services) use a service or download a piece of software, or purchase goods, which are provided by another person or company. Your use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms of Service do not affect your legal relationship with these other companies or individuals.

Livingin.lt Accounts

1. In order to access some features and certain services on the Website, you will have to create a Livingin.lt account. You agree that that any registration information you give to Livingin.lt will always be accurate, correct and up to date.
2. Here are some commitments you make to us relating registering and maintaining the security of your account
   1. You may not provide any false personal information on Livingin.lt, or create an account for anyone other than yourself.
   2. You will not use Livingin.lt if you are under 13 years old.
   3. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.

General Use of the Website – Permissions and Restrictions

Livingin.lt hereby grants you permission to access and use the Website as set forth in these Terms of Service, provided that:

1. You agree not to distribute in any medium any part of the Website, including but not limited to User Submissions (User Questions and User Comments are collectively referred to as "User Submissions").
2. You agree not to alter or modify any part of the Website.
3. You agree not to use the Livingin.lt Website for any commercial use, without the prior written authorization of Livingin.lt. Prohibited commercial uses include any of the following actions taken without Livingin.lt express approval:
   1. Sale of access to the Website or its related services.
   2. Use of the Website or its related services, for the primary purpose of gaining advertising or subscription revenue;
   3. You agree not to reproduce, duplicate, copy, sell, trade or resell the Services for any purpose, unless you have been specifically permitted to do so in a separate agreement with Livingin.lt.
   4. You agree not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions.
   5. Prohibited commercial uses do not include:
      1. Any use that Livingin.lt expressly authorizes in writing.
4. If you use the Livingin.lt logo or any of its services on your website, you must include a prominent link back to the Livingin.lt website, you may not modify, build upon, or block any portion of the Livingin.lt website or its services in any way.
5. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the Livingin.lt servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.
6. You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by Livingin.lt, unless you have been specifically allowed to do so in a separate agreement with Livingin.lt. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including scripts and web crawlers)
7. Livingin.lt reserves the right to discontinue any aspect of the Livingin.lt Website at any time.

Your Use of Content on the Site

1. In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of content on the Livingin.lt Website.
   1. You may access User Submissions for your information and personal use solely as intended through the provided functionality of the Livingin.lt Website. You shall not copy or download any User Submission unless you see a “download” or similar link displayed by Livingin.lt on the Livingin.lt Website for that User Submission.
   2. User Comments are made available to you for your information and personal use solely as intended through the normal functionality of the Livingin.lt Website. User Comments are made available "as is", and may not be distributed, transmitted, broadcasted, displayed, sold, licensed, downloaded, or otherwise exploited in any manner not intended by the normal functionality of the Livingin.lt Website or otherwise as prohibited under this Agreement.
   3. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any misuse or distribution of User Submissions of third parties obtained through the Website for any commercial purposes.
2. Livingin.lt gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive licence to use the software provided to you by Livingin.lt as part of the Services as provided to you by Livingin.lt. This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Livingin.lt, in the manner permitted by the Terms.
3. You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically told that you may do so by Livingin.lt in writing.

Your User Submissions and Conduct

1. As a Livingin.lt account holder you may submit textual content ("User Comments, Questions, etc."). User Questions and User Comments are collectively referred to as "User Submissions." You understand that whether or not such User Submissions are published, Livingin.lt does not guarantee any confidentiality with respect to any User Submissions.
2. You shall not post anyone’s identification documents or sensitive financial information on Livingin.lt.
3. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize Livingin.lt to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions. You acknowledge and agree that you are solely responsible for the consequences of your actions in any relation with your own User Submissions.
4. For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to Livingin.lt, you hereby grant Livingin.lt a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Livingin.lt Website and Livingin.lt’s (and its successors' and affiliates') business and the government, including without limitation for promoting and redistributing part or all of the Livingin.lt Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Livingin.lt Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. You understand and agree, however, that Livingin.lt may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted. The above licenses granted by you in User Comments are perpetual and irrevocable.
5. In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Livingin.lt all of the license rights granted herein.
6. You further agree that you will not, in connection with User Submissions, submit material that is contrary to the Livingin.lt, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.
7. Livingin.lt does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Livingin.lt expressly disclaims any and all liability in connection with User Submissions. Livingin.lt does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and Livingin.lt will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. Livingin.lt reserves the right to remove Content and User Submissions without prior notice.

Proprietary Rights

1. You acknowledge and agree that Livingin.lt own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Services may contain information which is designated confidential by Livingin.lt and that you shall not disclose such information without Livingin.lt’s prior written consent.
2. You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trade mark notices), which may be affixed to or contained within the Services.
3. Unless you have been expressly authorised to do so in writing by Livingin.lt, you agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organisation in a way that is likely or intended to cause confusion about the owner or authorised user of such marks, names or logos.

Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE LIVEIN.LLT WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, Livingin.lt, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. LIVIEN.LT MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA Livingin.lt WEBSITE. YOU SPECIFICALLY ACKNOWLEDGE THAT LIVE.LT SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

Indemnity

You agree to defend, indemnify and hold harmless Livingin.lt, its parent corporations, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Livingin.lt Website; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defence and indemnification obligation will survive these Terms of Service and your use of the Livingin.lt Website.

Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are over the age of 13.
